Service and Terms

A. Definitions
1. Unit- portable toilet rental
2. Service technician- Biros Utilities Inc. employee, route driver
3. Service- When a technician cleans a rental product at a rental location
4. Site contact- Person responsible for the rental product at the rental location

B. Your Portable toilet rental includes
1. paper product (toilet paper)
2. hand sanitizer gel
3. once a week scheduled service

C. Required items listed to make your rental experience the best that we can
1. Level area for placement with no overhead or side obstructions that
could cause damage to a truck, driver or rental product. Failure to provide a
level surface may affect the rental’s suitability.
2. Unit will be placed within 25’ or less of truck access for weekly service.
3. Weekly service times or days may vary depending on but not limited to,
weather, traffic, breakdowns, acts of nature, unforeseen issues and any
other reason to disrupt service.
4. Service technicians are given a maximum of 6 (six) minutes per unit per
service
5. For on-site issues the service technician is instructed to first call the site
contact, then notify Biros Utilities Inc. office to contact customer.
Issues may be
Connot find a unit, example would be renter moved unit or new assigned service technician
Cannot access a unit, example would be open trench, blocked by equipment, delivery truck in the way
Contact didn’t answer a phone call
Gate is locked
*The driver is only allowed to wait up to 10 (ten) minutes before leaving for the
next service unless otherwise specified.

D. The listed and unlisted items DO NOT warrant a refund of any kind.
1. We do not drive in grass or soil. If the customer requests the rental product to
be placed in grass or a grassy area, the customer assumes any and all
responsibility for any and all damage to their property and to any equipment
and vehicles owned by Biros.
2. Unit that are placed inside fenced in areas. The customer is responsible for
making sure the unit is accessible for service and pick up when needed. If
Biros Utilities rental property is fenced in and locked at the time of pick up, we
reserve the right to cut a chain to obtain our rental property.
3. Biros Utilities Inc. is not responsible for any damage to property, loss of
property, grass damage, drainage damage, or any other issue that may arise
at the location while our rental product is at the rental location.
4. Blow overs are considered an “act of nature” This doesn’t constitute an
emergency, or quick cleanup response by Biros Utilities Inc. In the event this
should occur please contact our business office during regular hours of
operation. A MDS ( Material Data Sheet) is available upon request for any
cleaning product or chemical used by Biros Utilities Inc.
5. Misplacement. If the contact information provided from a renter to Biros
Utilities are inaccurate or the contact is unreachable or unavailable at the
Time of delivery then Biros will place the unit in the best possible area as the
delivery tech feels are appropriate. Renter releases any claims against Biros in
the event that such placement occurs. Biros is not responsible for replacing
the unit. If immediate response for replacement or moving the unit is needed
a minimum $50 fee will be charged for each unit based upon area and
availability.
6. After-hour fees will apply if defined by Biros Utilities Inc. “After Hours” policy.
7.“After hours” is defined by a call, want, request, delivery, pick up, blow over or
need of service that is not scheduled ahead of time or before the hours of 8
a.m. and after 4 p.m. Monday through Friday. Saturday, Sunday, and
Holidays are considered “after hours”. Saturday, Sunday & Holidays
emergency after hours fees start at $150.00 per call. Sunday & emergency
after hours fees start at $250.00 per call.
These fees do not include holiday rates. These fees do not include cost of
an unscheduled service.
8. Immediate booking is recommended to guarantee availability. We
recommend booking at least 1 week prior. Bookings that are made week-of,
will be subject to delivery fees based upon availability and area.
9.Late payments, unless otherwise stated to the office, special agreements,
contracts, company policy.
2 months of non-payment will result in, suspension of services with a $25 suspension fee. Once payment is made in full including the suspension fee, service will resume at the option of Biros.
3 months of non-payment will result in the pick-up of units. If the unit is picked up due to non-payment, there will be a $50 drop off
and $25 suspension fee applied with the monthly fees owed. Upon payment of the rental and fees in full, Biros, at its sole discretion, may return a unit to the site.

E. Cancelation fees
1. Cancelation within 30 days of an event will result in a 75% refund.
2. Cancelation within 15 days of an event will result in a 50% refund.
3. Cancelation within 7 days of an event will result in a 25% refund.
4. Cancelation within 48 hours of an event will result in a 0% refund.
5. There will be a minimum of $50.00 cancelation fee retained for a single unit
rental call off for any time frame prior to the scheduled drop off.
6. In the event of an emergency call-off prior to loading at the Biros facility will
result in a 25% refund.
7. In the event of a “dry run” will result in a 50% refund.
*A dry run is defined as staff has been activated, units are being loaded, have
been loaded, are in route to delivery, have arrived at the delivery location.
8. In the event staff has been activated, units are loaded and delivered. This
will result in a 0% refund.
*Delivered or delivery is defined as the unit or units have been unloaded from
the delivery vehicle at the location provided by the renter.

E. Collection
If Biros files suit or undertakes any collection activities, then renter is
responsible for payment of all collection costs, court costs, reasonable and
customary attorney fees incurred by Biros.

F. Agreement
By booking with Biros Utilities Inc., you agree to the terms set forth
by Biros Utilities Inc. stated in this document.
